Acceptance of our Conditions of use

Your use of this site will be deemed to mean that you have accepted whatever Condition of Use exist at the time and that as such you accept the basis upon which we want our website used.

RETURNS

Please note that each item is personally inspected by one of us at 'Til The Sun Goes Down' for quality control before it is packaged and sent out for delivery. We make absolutely sure that each item is in perfect condition when we send it to you.

Please note that as each garment will be made to your specific request of style, colour and size we will not be able to accept returns in most circumstances. In the unlikely event that you're able to find a fault with either the fabric or construction which has got past all our very keen eyes, we would look at each case individually.

In all cases concerning returns we would wish to make clear that if a garment shows signs of mistreatment; whether it is from incorrect laundering or rough treatment we could not refund payment. Worn just 'once' is not an acceptable reason for returning goods and also means we would not be able refund.

We are a company wanting to deliver the very best to our customers and we would always endeavour to address all problems and find a happy conclusion.

Please note that although we have taken all possible steps to ensure that the product images are representative of the product as best as possible, colours may vary according to settings on your screen and therefore can only be an approximation of the actual product.

Unfortunately all fabrics & trimmings are cut to your individual specification and therefore cannot be returned.

DELIVERY COST

UK delivery costs £3.50. All orders will require a signature on receipt. Your goods will be delivered within 1 - 2 working days from day of despatch.

We also offer European and International delivery. For international deliveries we allocate a courier which we believe will deliver your order to you most efficiently depending on your destination. You will be notified by email of the progress of your shipment by the courier or transit company.

Please note, if your destination is outside the EU, you are liable for all import duties, customs, and local sales taxes levied by the country you are shipping to; therefore payment will be required by customs to release your order. We recommend that you investigate potential charges before placing your order, as different countries have variable procedures.

To register with tilthesungoesdown.com you must be over 18 years of age and you must ensure that the details you have provided are fact and complete at the time of registration.

Pricing & Availability

Prices and availability of our products and services advertised on this website may be changed when necessary.

We endeavour to keep all information on this website up to date, but the content is provided by way of information only and will need to be confirmed at time of enquiry.The information and materials contained on our website are provided without guarantee but with our best and genuine intention.

In the event that an order placed by a customer is unavailable or damaged, we reserve the right to give the customer a full refund. In this situation the customer will be notified by e-mail/phone call. All our product prices are listed in UK Sterling and are inclusive of VAT.

Orders

Delivery and shipping/postage rates are subject to change at any time. Once an order has been dispatched we are unable to take responsibility for any delay. This will be the responsibility of the selected courier which will be made known in your Confirmation of Dispatch e-mail.

Customs and Duty

If your destination is outside of the EU, you will be liable for all import duties, customs, and local sales taxes levied by the country you are shipping to; therefore payment will be required by customs to release your order. We will not take responsibility for any charges, fees or duties and not accept refunds relating to this.

Postage charges and delivery times

For any items purchased from our online store, we aim to have these dispatched within 3 working days and delivered to you within 7 working days but our aim will always be to deliver as soon as possible.

UK delivery: £3.50

Europe and the rest of the world: Costs may differ for each country and depending upon weight of goods. Please call for details and confirmation of postage charges before ordering.

Returns

We sincerely hope you will be 100% happy with your purchase.

However if for some reason you need to return your purchase, please ensure that the item is in completely unused condition , or in the case of a genuine Vintage item - the same condition as on receipt. The customer has a duty of care to all purchases that are to be returned.

The postage costs to return the product will be the customer's responsibility and will need to be sent by means that may be tracked or signed for.

Please contact us either by phone, or email before returning any product, with your reason for the return.

Please note all refunds will be by cheque or returned to the card used for payment.

Under the Consumer Protection (Distance Selling) Regulations 2000 ("the Regulations"), UK customers have the right to cancel an order placed with us within 7 (seven) working days of receipt of the goods.

This does not include items that have been cut to your specifications or made to measure/order.

These Regulations are designed to protect consumers when buying products by mail order or over the internet as opposed to in person in a shop.

To cancel an order under the Regulations you must notify us in writing by first-class post, fax, or E-mail, quoting your name, address and contact telephone number. Our Company Details and address for postal notification of cancellation, any written complaints, and for returning goods can be found on our contact page.

The effect of the Regulations is to allow a UK customer to withdraw from the contract as if it had not been made. However, there are certain important conditions and limitations. Please read them carefully. These are:

  1. Cancellation must be in writing, by first class post or e-mail. A telephone call is not sufficient.
  2. You must return the goods to us at your expense (including all packaging, product boxes, etc.) Goods must be returned in exactly the same condition in which they were supplied to you. A prompt return of goods will enable an earlier refund but in all cases it will be no later than 30 days.
  3. Please note that proof of posting is NOT proof of receipt. You are liable for the goods until they are delivered to us. We strongly advise you to use Royal Mail Special Delivery or other insured and tracked delivery service for this purpose in order to be sure that any goods returned are delivered safely to us.

These conditions do not affect your statutory rights.
